1. Agreement to Terms

Welcome to PetGuard. These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and PetGuard LLC ("Company," "we," "us," or "our"), concerning your access to and use of the PetGuard website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Site and you must discontinue use immediately.

PetGuard operates as a comparison and referral platform that connects consumers with pet insurance providers. We are not a direct provider of pet insurance services. Our platform allows users to compare different pet insurance options, receive quotes, and connect with licensed insurance agents.

The information provided through our platform is for general informational purposes only. We strive to provide accurate and up-to-date information, but we make no representation or warranty of any kind regarding the accuracy, adequacy, validity, reliability, availability, or completeness of any information on the Site.

3. User Eligibility and Responsibilities

By using our services, you represent and warrant that you are at least 18 years of age and possess the legal authority to enter into a binding agreement with us and the insurance providers we connect you with.

You are responsible for providing accurate and complete information when using our services. This includes but is not limited to personal information, pet information, and contact details. Providing false or misleading information may result in the termination of your access to our services and potential legal consequences.

4. Information Accuracy and Quotes

While we strive to provide accurate information about pet insurance options, all quotes provided through our platform are estimates only. Final premium amounts, coverage details, and policy terms are determined by the insurance providers themselves and may differ from the estimates provided on our platform.

Insurance quotes are subject to verification of the information provided by you and are subject to change based on the insurance provider's underwriting guidelines, your pet's health history, and other factors determined by the insurance provider.

5. Third-Party Relationships

PetGuard partners with various pet insurance providers to offer comparison services. We may receive compensation from these providers when you purchase a policy through our platform or when you are connected with an agent.

We do not endorse or guarantee the products or services offered by these third-party providers. Any transaction you enter into with a third-party provider is strictly between you and that provider. We are not responsible for the actions, products, services, or content of third-party providers.

6. Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights.

The Content and Marks are provided on the Site "AS IS" for your information and personal use only. If you wish to terminate your account, you may simply discontinue using the Site. All provisions of these Terms and Conditions which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms and Conditions and your use of the Site are governed by and construed in accordance with the laws of the State of Delaware applicable to agreements made and to be entirely performed within the State of Delaware, without regard to its conflict of law principles.
